Terms of Service | LuluFox Photo

These terms cover Photo Den Pass Memberships (Monthly and Annual), Studio Single Pass, Shoot Upgrades (Model, White Background), Additional Product Add-Ons, Editing Service (client-supplied images), Styling Playbook, and Flourish Mentor Calls. By purchasing, you agree to these terms.

1) Memberships & Sessions

A. Photo Den Pass — Monthly (Evergreen Retainer)

  • Retainer Nature: This is a monthly retainer for studio access, reserving your spot each month. All monthly retainer payments are non-refundable once billed, regardless of whether you send products that month.

  • Billing: Auto-renews monthly until canceled. Cancel anytime before your next billing date; partial months are not refunded.

  • Included each month: Studio time for up to 3 products, styled and photographed in a lifestyle look.

  • Ship-by rule: Products must arrive by the 7th (local time) to be in that month’s cycle. Late arrivals roll to the next cycle.

  • No rollover: Unused product slots do not carry over.

B. Photo Den Pass — Annual (Paid Upfront Retainer)

  • Retainer nature: This is a 12-month retainer for studio access, paid in full. Non-refundable once active.

  • Billing: Pay once for 12 months. Saves $189 vs monthly. Same ship-by, no-rollover as Monthly.

C. Photo Den Single Pass (One-Time)

  • What it covers: One photo session for the number of products selected at checkout (tiered options available).

  • Shipping and timeline: If your items arrive by the 7th, your gallery will be ready by the end of that month. Items arriving after the 7th roll into the following month’s editing window.

  • Validity: The Single Pass is valid for 12 months from the purchase date.

  • Refunds: The Single Pass is non-refundable once a one-on-one call has been completed. If no items are received within the 12-month validity period, the session is forfeited and no refunds or credits will be issued.

2) What’s Included vs. What’s Purchased

  • Edited Preview Gallery: Delivered by the end of the month (if items arrive by the 7th). Fully edited and watermarked; no unedited proofs.

  • Final Files: Delivered within 24 hours after purchase of images from your gallery.

  • Images are purchased separately: Choose Singles (from $49), 3/5/10 bundles, or Buy-All in your gallery. Prices may change with notice.

3) Products, Sets & Add-Ons

A. Product Limits

  • Membership includes up to 3 products per month.

  • Collection sets: Up to 4 coordinating items photographed together count as 1 product and include group shots only.

B. Solo Photos from Sets

  • Solo photos of items within a set count as additional products.

  • Use the Additional Product Add-On to include solos that month.

C. Additional Product Add-On (Members Only)

  • $45 per extra product (availability may vary; typically limit up to 2 per month).

  • Must arrive by the 7th with your shipment. Images purchased separately.

D. Shoot Upgrades (Members save 20% on upgrades)

  • Model Shoot Upgrade (adds modeled/hand/partial-model lifestyle shots).

  • White Background Upgrade (solid white backdrop for marketplace-ready images).

  • Upgrades apply per shoot/month, do not include image credits; images are still purchased separately.

4) Turnaround & Delivery

  • Preview Gallery: By the end of the month (items must arrive by the 7th).

  • Final Files: Within 24 hours after you purchase images.

  • Delays: Carrier delays, weather, or force majeure may shift timelines. Late arrivals move to the next cycle to protect quality.

5) Shipping

  • Client pays shipping both ways. Include a pre-paid return label in your package.

  • We are not responsible for loss/damage in transit; please use tracking and insurance.

  • Ship to: Studio Address provided in your welcome email.

6) Styling, Creative Direction & Styling Playbook

  • Styling Playbook: Members receive a simple guide for props, color, and brand style. For your internal use only; not for resale/sharing.

  • Creative discretion: We plan, style, light, and edit in a lifestyle look consistent with LuluFox Photo’s portfolio and your intake notes. We do not replicate another photographer’s exact style.

  • Props: Light props may be used to support your brand story. Provide “do/don’t” notes during intake.

7) Editing Service (Client-Supplied Images)

  • Scope: We edit your product photos (color, exposure, cleanup, light retouch). This is not AI art or heavy compositing.

  • Files: Provide high-res JPEG/TIFF or RAW (if requested). You confirm you own rights to the images.

  • Turnaround: Typical 5–7 business days for up to 30 images after files and payment are received (rush by request).

  • Revisions: Includes 1 round of minor tweaks (color/contrast/crop). Additional edits billed separately.

  • Ownership: You retain ownership of your originals.

8) Flourish Mentor Calls (Coaching)

  • Scheduling: Book online.

  • Rescheduling: 24 hours’ notice required.

  • No-show/late cancel: Session is non-refundable.

  • Scope: Business/brand guidance; not legal/tax/financial advice.

  • Confidentiality: We keep your info private; please do the same with any materials we share.

9) Payments, Refunds & Cancellations

  • Retainers are non-refundable: Photo Den Pass Monthly and Annual payments are non-refundable as they reserve studio access/time.

  • Images & services: Image purchases, delivered galleries, sessions already in pre-production, upgrades, add-ons, editing services, and mentor calls are non-refundable once delivered or begun.

  • Limited refund window (non-retainer only): For non-retainer items (e.g., Studio Single Pass not yet in pre-production, Editing Service not yet started, mentor call not yet scheduled), you may request a refund within 30 days of purchase. A brief cancellation form is required.

  • Lapse of use: If items are not received within 1 year of purchase for a package/session, services are forfeited.

10) Gallery Access, Archiving & Recovery

  • Purchasing window: You may purchase/download images for 1 year from your gallery delivery date.

  • Archive: After 1 year, images are archived for an additional 1 year.

  • Recovery: Cloud Archive Recovery is $49 during the archive period.

  • Deletion: After the archive period, images are permanently deleted.

11) IP, Copyright & License

  • Copyright: LuluFox Photo retains copyright to images we create/edit. RAW files are not released.

  • Client license (standard commercial use): When you purchase final images, you receive a non-exclusive, non-transferable commercial license for your business marketing: website, e-commerce listings (Etsy/Amazon/Shopify), email, organic social, and printed materials.

  • Not included: Resale/redistribution to third parties (e.g., wholesalers/agencies) or other brands without an extended license.

  • Extended licensing: Contact us if you need to share images with wholesale partners or the press.

  • Credit: Crediting “LuluFox Photo” where practical online is appreciated but not required. Overlays for marketing are allowed; do not add filters/edits that misrepresent the work.

12) Content Limits (IP & Safety)

  • We do not photograph products that infringe on copyright/trademark. If your product uses protected IP, you must provide written license.

  • We may decline projects that are unsafe, illegal, or not a fit.

13) Communications & Files

  • Galleries and downloads are sent by email.

  • No screenshots or screen recordings of preview galleries.
    Preview galleries are for viewing only and display watermarks. Any capture, download, screen recording, AI upscaling, or cropping of watermarks is unauthorized copying and a violation of copyright. You may only download and use images you have purchased (licensed). Unauthorized use will be invoiced at 3× standard image price (or $250/image minimum) and must be removed within 48 hours of notice.

  • Final files do not include watermarks.

  • Please keep your contact info current.

14) Liability & Force Majeure

  • We are not liable for indirect/consequential damages, lost sales, or delays outside our control (carrier delays, weather, illness, outages, force majeure). Delays move you to the next available cycle.

  • Our total liability is limited to the amount paid for the affected service.

15) Changes to Terms

  • We may update these terms; the current version appears here with the “Last updated” date. Continued use means you accept updates.
